Terms & Conditions
Payment
Payment is due within 30 days of invoice receipt. We accept cash, check, and all major credit cards. All invoices are subject to a 25% late fee.
Cancellation Policy
If you need to cancel or reschedule your photoshoot, please provide at least 24 hours' notice. If the cancellation is made less than 24 hours before the scheduled appointment, the client will be charged 50% of the agreed upon fees and services.
Rescheduling
Rescheduling must be made at least 24 hours prior to the scheduled appointment. In the event that the property is not ready for the shoot, a rescheduling fee may apply.
Weather
Outdoor photography is weather dependent. If inclement weather prevents us from completing the shoot, we will reschedule at no extra cost to the client.
Turnaround Time
The estimated turnaround time for all photographs will be within 24 hours of the shoot. Elevate will deliver final images, videos, or any other deliverable to the client within the agreed upon timeline. We will not be held liable for any delays in delivery caused by circumstances beyond our control.
Copyright & Image Usage
The client is granted a non-exclusive, non-transferable license to use the deliverables for the purpose of promoting and selling the property. However, the client will not have the right to use the images for any other purpose without the written consent of our company. The client will also not have the right to sell or distribute the images to any third party without the written consent of our company. The media taken by our team are protected by copyright laws. The copyright of all photographs remains the property of the photographer. Any unauthorized use of the media will be considered a violation of our copyright and may result in legal action. Elevate Drone Services can use client media for marketing, trade shows, and other promotions.
Model Release
The client is responsible for obtaining the necessary model releases for any individuals who appear in the photographs.
Travel
If additional travel is required by any team member of Elevate Drone Services, LLC, trip charges may be invoiced.
Retouching
Basic retouching, such as color correction and exposure adjustment, will be included in the cost of the shoot. Any additional advanced retouching, such as virtual staging, will be subject to an additional fee.
Liability
The photographer shall not be liable for any loss or damage to the property during the shoot. It is the client's responsibility to ensure that the property is in a suitable condition for photography prior to the shoot. The client must also agree to provide a safe working environment for our photographers and videographers. This includes but not limited to providing a safe path of travel, proper lighting and ventilation, and any necessary safety equipment. Our company will not be held liable for any accidents or injuries that occur on the property.
Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of the state in which the shoot takes place.
Entire Agreement
This agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings, whether oral or written.
Shot Selection
All Real Estate Photography Packages include an optional Virtual Tour & Property Website. This must be requested at the order. no discounts apply.
By using our services, the client agrees to indemnify and hold harmless our company and its team members from any and all claims, damages, and expenses arising from the use of the deliverable.
